AN ACT

1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, prohibiting operators from using handheld mobile
3 telephones.

4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 75 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 3316. Prohibiting use of handheld mobile telephones.
9 (a) General rule.--Except as provided in subsection (b), no
10 driver shall operate any moving vehicle on a highway of this
11 Commonwealth, which shall include Federal, State and municipal
12 highways, while using a handheld mobile telephone.
13 (b) Exception.--This section shall not apply to law
14 enforcement officers and operators of emergency vehicles when on
15 duty and acting in their official capacities.

1 (c) Defense.--It shall be a defense to a prosecution brought
2 for a violation of this section that the driver had reason to
3 fear for the driver's safety, was reporting a traffic accident
4 or was making a "911" emergency call.
5 (d) Penalty.--A person who violates this section commits a
6 summary offense and shall, upon conviction, be sentenced to pay
7 a fine of $50.
8 (e) Definitions.--As used in this section, the following
9 words and phrases shall have the meanings given to them in this
10 subsection:
11 "Handheld mobile telephone." A mobile telephone other than a
12 hands-free mobile telephone with which a user engages in a call
13 using at least one hand.
14 "Hands-free mobile telephone." A mobile telephone that has
15 an internal feature or function, or that is equipped with an
16 attachment or addition, whether or not permanently part of such
17 mobile telephone, by which a user engages in a call without the
18 use of either hand, whether or not the use of either hand is
19 necessary to activate, deactivate or initiate a function of such
20 telephone.
21 Section 2. This act shall take effect in 60 days.

i just got off the phone with my buddy who is a Deputy Sheriff for montgomery county, he says it is a law and it goes into affect in 15days

This was passed into law and will go into effect in 60 days. It will be a $50.00 fine and a summary offense, which means it will not be a moving violation. We need this law, to many driving and talking and to many people getting hurt in the process. If you have to talk and drive try a blue tooth. They are about $30.00 and easy to operate.

Are you sure this was passed into law, the 13th line down says
"REFERRED TO COMMITTEE ON TRANSPORTATION, SEPTEMBER 11, 2007"
I think it is a good idea, but I don't think it has made it out of committee yet.

$50 doesn't seem like enough of a deterrent really. That's someone's cell phone bill for 1 month. $500 might make people think twice though. Oh well, its a start and it will probably help since the average person may not know the fine, but will see notices or signs stating the illegality.

Not sure this was passed - appears to have been introduced only

Either way - how many of these legislatures will follow the rule? I think it's a good law because too many people are pre-occupied with answering, dialing etc to pay attention to what's happening around them

It's been a Law in NJ. for over a year now.
I see more people on cell phone now more than ever.
The worst offenders seem to be female drivers. I see them every day in traffic on RT1 in NJ.
Had a teenage girl pull out of a gas station on her phone right in front of me. I had to stand on the brakes so as not to hit her. She never even looked my way.
The fine should be at the least, $250.

Don't we already have a reckless driving law and other laws that would take care of this? There are already a number of distractions in our cars (radios, HVAC, etc). Glad this is a hoax. Call me crazy but I thought this was the Land of the Free...

Obviuosly the legislature felt (after what was obviously significant lobbying from the families of victims) that the present laws left a hole in protection of the population at large.

The legislation is not a hoax and will go into effect on Nov. 10, 2007. See the previoulsy attached legislative brief.

THIS IS NOT LAW !!

According to the article in the newspaper which reported this as a HOAX and a Bill which has Not yet been approved by the State Legislature but has "Been referred to committee". This article was published in the Philadelphia Inquirer on Sunday October 14, 2007. If this WAS indeed law it would be All over the place and not information being only available and making the rounds on various web-sites.

Thanks Bob. I should know better that to believe a document purporting to be a legislative brief.
